6. Artificial Intelligence and Generated Insights

Artificial intelligence is central to ConvertTide's functionality. Our Services may analyse business information, product descriptions, marketing objectives, and other submitted content to generate buyer personas and audience recommendations.

6.1 Nature of AI-generated content

You acknowledge that AI-generated content:

  • May contain inaccuracies or omissions
  • May rely on incomplete information
  • May generate similar results for different users
  • Does not necessarily represent verified market research
  • Does not guarantee that suggested audiences will purchase your products
  • May require independent validation before use

You are responsible for reviewing AI-generated insights before making important business decisions.

6.2 No guaranteed results

ConvertTide does not promise or guarantee:

  • Increased sales or revenue
  • Advertising campaign profitability
  • Specific conversion rates
  • Improved return on advertising spend
  • Guaranteed customer acquisition
  • Complete accuracy of buyer personas
  • Successful advertising platform targeting

Results depend on multiple factors, including your products, pricing, market conditions, advertising strategy, budget, and execution.

6.3 AI recommendations

Audience recommendations generated by ConvertTide are intended to assist your marketing decisions. They should not be treated as verified profiles of specific individuals unless supported by appropriate, lawfully obtained data. You remain responsible for deciding whether and how to use any generated insights.

6.4 Third-party AI technology

ConvertTide may rely on third-party artificial intelligence models, APIs, and infrastructure providers. These technologies may have their own technical limitations and service dependencies. We may update or replace underlying AI technologies as necessary to improve the platform, subject to our obligations under applicable law and existing customer contracts.

7. User-Submitted Content

You may submit information to ConvertTide, including product descriptions, business details, customer research, brand information, and marketing objectives. You retain ownership of any intellectual property rights you hold in your original content.

By submitting content, you grant ConvertTide a limited, worldwide, non-exclusive licence to host, process, transmit, reproduce, and use that content as reasonably necessary to provide the Services, maintain security, and perform processing disclosed in our Privacy Policy.

You confirm that:

  • You own or have permission to submit the content
  • Your submissions do not unlawfully infringe third-party rights
  • You have an appropriate lawful basis for submitting personal information
  • Your content does not violate applicable laws
  • You will not knowingly submit malicious code or harmful materials

ConvertTide does not claim ownership of your original product descriptions, branding, or business information.

8. Ownership and Use of AI-Generated Outputs

Subject to applicable law, third-party rights, and your compliance with these Terms, you may use AI-generated buyer personas, marketing insights, and audience recommendations produced through your account for lawful personal or commercial purposes.

ConvertTide does not claim exclusive ownership of your AI-generated outputs. However, because artificial intelligence can produce similar responses to similar prompts, generated outputs may not be unique.

We do not guarantee that AI-generated materials are eligible for copyright protection, free from third-party rights, or suitable for every commercial application. You are responsible for reviewing generated materials before publishing, distributing, or using them commercially.

These rights do not transfer ownership of ConvertTide's underlying software, algorithms, branding, platform design, or proprietary technology.

9. Acceptable Use Policy

You agree not to misuse ConvertTide. Prohibited activities include:

  • Using the platform for unlawful, fraudulent, or deceptive purposes
  • Attempting to gain unauthorised access to accounts or systems
  • Introducing viruses, malware, or malicious software
  • Reverse engineering or attempting to extract proprietary source code except where permitted by law
  • Circumventing subscription limits, usage restrictions, or security measures
  • Reselling access to the platform without permission
  • Using automated systems to overload or disrupt the Services
  • Violating intellectual property rights
  • Submitting personal information obtained unlawfully
  • Using generated information to facilitate unlawful discrimination, harassment, or privacy violations
  • Misrepresenting AI-generated assumptions as verified facts about identifiable individuals
  • Using the Services to conduct unlawful advertising, spam, or deceptive marketing campaigns

We may investigate suspected violations and take proportionate action, including restricting or suspending access where reasonably necessary.

10. Subscription Plans and Pricing

ConvertTide may offer free, trial, paid, or subscription-based access. The available plans, features, usage limits, billing periods, and prices will be described on our website or during checkout.

By purchasing a paid subscription, you agree to pay the charges disclosed before completing your purchase. Prices may vary based on subscription type, location, promotional offers, or selected features. Where applicable, taxes will be displayed or explained before payment.

We reserve the right to introduce new subscription plans or change pricing for future purchases. Any changes to an existing subscription will be communicated in accordance with applicable law and the terms disclosed at purchase.

11. Payments and Billing

Payments may be processed through authorised third-party payment providers. When purchasing a subscription, you agree to provide valid and accurate payment information.

If a subscription automatically renews, the recurring payment amount, billing frequency, renewal terms, and cancellation method will be disclosed before purchase. Where automatic renewal is offered, you authorise the applicable payment provider to collect recurring charges until the subscription is cancelled or otherwise ends.

We will provide required notices and cancellation arrangements in accordance with applicable consumer protection law. If a payment fails, we may request updated payment information and temporarily restrict paid features after giving appropriate notice.

12. Cancellation and Refunds

You may request cancellation of your paid subscription or account by emailing converttidedev@gmail.com. Where self-service cancellation is available, you may also use the relevant account settings.

Cancellation of a recurring subscription ordinarily stops future renewal charges, subject to the terms disclosed at checkout and your applicable statutory rights. Access to paid features after cancellation will depend on the applicable subscription arrangements.

12.1 Consumer cancellation rights

If you purchase ConvertTide as a consumer, you may have a statutory right to cancel certain online contracts within 14 days. The application of this right depends on the type of service or digital content supplied and whether performance or immediate access has begun.

Where legally required, we will obtain your express consent before beginning immediate delivery of digital content and obtain any necessary acknowledgement about the effect on cancellation rights. We will not treat statutory cancellation rights as waived unless the applicable legal requirements have been satisfied.

12.2 Refund requests

Refund requests may be submitted to converttidedev@gmail.com. We will assess requests based on the subscription terms disclosed at purchase and applicable consumer protection laws.

Nothing in these Terms removes or restricts any statutory right to a refund, price reduction, repair, repeat performance, or other remedy where required by law.

Commercially, unused AI credits on a cancelled paid plan are not refunded as cash unless required by law or expressly stated at checkout. Access typically continues until the end of the paid billing period when you cancel renewal.

13. Free Plans, Trials, and Promotional Offers

ConvertTide may offer free plans, limited trials, promotional credits, or discounted subscriptions. Such offers may be subject to additional conditions, including eligibility, time limits, usage restrictions, or feature limitations. The applicable terms will be disclosed when the offer is presented.

Where a free trial automatically converts to a paid subscription, we will clearly disclose the applicable price, billing date, and cancellation arrangements before enrolment. Promotional offers may be amended or withdrawn for future customers, subject to any existing contractual commitments.

14. Usage Limits and Fair Use

Certain ConvertTide features may be subject to usage limits. These may include limits on buyer persona generations, AI requests, audience analyses, saved reports, account access, API usage if available, and other computationally intensive features.

Specific limits will be explained within the platform or applicable subscription details. We may take reasonable steps to protect platform reliability, including measures to prevent abusive or excessive automated activity. Material changes affecting paid subscription entitlements will be handled in accordance with applicable contractual and consumer protection requirements.

15. Intellectual Property Rights

The ConvertTide platform, including its software, interface, branding, logos, website design, proprietary systems, and related materials, is owned by or licensed to the operator of ConvertTide. These materials are protected by applicable intellectual property laws.

Except as expressly permitted under these Terms, you may not:

  • Reproduce proprietary platform materials without authorisation
  • Distribute or sell our software
  • Use our branding in a misleading manner
  • Remove copyright or ownership notices
  • Claim ownership of our technology
  • Create unauthorised derivative versions of protected platform materials

Your right to use generated outputs under Section 8 does not grant ownership of ConvertTide's underlying technology.

16. Data Privacy and Protection

We are committed to handling personal information in accordance with applicable data protection laws. Our collection, use, storage, and sharing of personal information are described in our Privacy Policy.

By using ConvertTide, you acknowledge that personal information will be processed as described in that policy. Where business customers submit personal data for processing on their behalf, additional data processing terms may apply. You are responsible for ensuring that customer information submitted to the platform is collected and processed lawfully.

17. Third-Party Services and Integrations

ConvertTide may use or integrate with third-party services, including artificial intelligence providers, cloud hosting services, payment processors, analytics systems, communication services, and advertising platforms where supported.

Your use of third-party services may be subject to separate terms and privacy policies. We are not responsible for independent third-party services outside our control, but this does not remove any responsibility we have under applicable law or our contracts with users.

18. Service Availability and Maintenance

We aim to provide reliable access to ConvertTide. However, the Services may occasionally be unavailable due to scheduled maintenance, technical failures, software updates, third-party outages, security incidents, network or infrastructure problems, or events outside our reasonable control.

We may temporarily restrict access when reasonably necessary to maintain, repair, or secure the platform. We will take reasonable steps to minimise disruption and communicate material interruptions where appropriate. Nothing in this section removes any legal rights arising from a failure to provide contracted services.

19. Changes to the Platform

We may introduce, improve, modify, or discontinue features as ConvertTide develops. Changes may be necessary for technical, security, regulatory, or operational reasons.

Where changes materially affect paid features, subscription entitlements, or the core Services, we will provide appropriate notice and respect any cancellation, refund, or other rights available under applicable law. We will not use this section to impose unfair or unexpected changes to existing consumer contracts.

20. Suspension and Termination

We may suspend or terminate access where reasonably justified, including where you materially violate these Terms, your account is involved in fraudulent or unlawful activity, you attempt to compromise platform security, you repeatedly misuse the Services, continued access creates a significant security or legal risk, or required payments remain outstanding after appropriate notice.

Where reasonable and lawful, we will provide notice and an opportunity to resolve a breach before permanently terminating access. You may discontinue use of ConvertTide and request account deletion by contacting converttidedev@gmail.com.

Termination does not remove rights or obligations that arose before termination, including accrued payment obligations and applicable statutory rights.

21. Disclaimer of Marketing and Business Outcomes

ConvertTide provides AI-assisted research and marketing intelligence. Generated buyer personas, high-intent audience suggestions, and marketing recommendations are intended as decision-support information. They do not guarantee customer behaviour, advertising performance, business growth, or financial returns.

You are responsible for conducting appropriate checks before implementing marketing strategies based on our outputs. ConvertTide does not act as your advertising agency, financial adviser, or legal adviser merely by providing AI-generated recommendations. Nothing in this section removes our obligation to provide Services in accordance with applicable law and the terms of your contract.

22. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be excluded. Nothing in these Terms affects mandatory consumer rights.

For users acting in the course of business, and to the extent permitted by applicable law, ConvertTide will not be liable for indirect or consequential losses, such as anticipated profits or business opportunities, where those losses are not a reasonably foreseeable result of our breach.

For business customers, ConvertTide's total aggregate liability arising out of or related to these Terms or the Services in any twelve-month period is limited to the amounts you paid to ConvertTide for the Services in that period, except where a higher or different amount is required by law or agreed in writing.

For consumers, our liability remains subject to mandatory consumer protection law, including rights relating to the quality, description, and performance of digital content and services.

23. User Responsibility and Third-Party Claims

You are responsible for ensuring that your use of ConvertTide, your submitted content, and your resulting marketing activities comply with applicable laws and third-party rights.

Where you act as a business user, you may be responsible for reasonable losses arising from your unlawful submissions or material breach of these Terms, subject to applicable law and normal legal principles governing liability. This section does not require consumers to accept disproportionate penalties or waive statutory rights.

24. Compliance with Advertising and Data Protection Laws

You agree to use ConvertTide's recommendations responsibly. When applying generated audiences or marketing insights, you must comply with relevant advertising, consumer protection, electronic marketing, and data protection requirements.

You must not use ConvertTide to:

  • Conduct unlawful discriminatory targeting
  • Send unlawful unsolicited marketing communications
  • Misuse sensitive personal information
  • Make deceptive advertising claims
  • Target individuals in ways prohibited by law
  • Circumvent advertising platform restrictions

You are responsible for reviewing any applicable rules imposed by advertising platforms you choose to use.

25. Governing Law and Disputes

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply in your country of residence.

If a dispute arises, we encourage you to contact us first at converttidedev@gmail.com so we can attempt to resolve it informally.

For business-to-business disputes, the courts of England and Wales will have jurisdiction, unless otherwise agreed in a valid contract. Consumers retain the right to bring proceedings in any court available to them under applicable mandatory law.

26. Changes to These Terms

We may update these Terms to reflect changes to our business, platform, technology, or legal obligations. When material changes are made, we will take reasonable steps to notify affected users.

Changes to existing paid subscriptions will be subject to applicable contract and consumer protection requirements. The updated Terms will display a revised last-updated date. Where legally required, we will obtain your agreement before applying changes to an existing contract.

27. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

28. Entire Agreement

These Terms, together with applicable subscription terms and any additional agreements expressly accepted by you, constitute the agreement governing your use of ConvertTide. They do not override mandatory rights or information that applicable law treats as part of your contract.
